Welcome to KÚR Collection. The terms “we”, “us”, and “our” refer to KUR Labs LLC (operating the brand KÚR Collection). We operate https://www.kurcollection.com/ and provide related information, content, features, tools, products, and services (collectively, the “Services”) to offer customers a curated shopping experience.

The Services are powered by Shopify, which enables us to host and operate the online store.

These Terms of Service (the “Terms”), together with any policies referenced here (including our Privacy Policy and Refund Policy, each incorporated by reference), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. They include important information about warranty disclaimers and limitations of liability.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

1. Access and Account

By using the Services, you represent that you are at least the age of majority in your state of residence.

You may be asked to provide information such as your name, email address, billing details, payment information, and shipping address. You agree that all information you provide is accurate, current, and complete, and that you have the right to provide it.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

2. Products and Availability

We make every effort to display our products accurately. However, colours and appearance may vary depending on your device and display settings. We do not guarantee that the appearance or quality of products will meet your expectations or will match how they appear on your screen.

Product descriptions, sizing, pricing, and availability may change at any time without notice. We may discontinue products at any time and may limit quantities offered to any person or order.

Special Request / Made-to-Order

From time to time, we may accept special request or made-to-order enquiries. These are handled case-by-case via info@kurcollection.com. Additional terms (including timelines, deposits, customisation limits, and refundability) may apply and will be confirmed in writing before production begins.

3. Orders

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order for any reason, including suspected fraud, resale activity, inventory issues, or errors in product or pricing information.

Your order is not accepted until we confirm acceptance (for example, by sending an order confirmation and successfully processing payment). Once an order is accepted, we may not be able to accommodate cancellation requests.

If we cancel or modify an order, we will attempt to notify you using the contact details provided at checkout.

Personal Use Only

You represent and warrant that purchases are for personal or household use and not for commercial resale or export.

Returns and Exchanges

All purchases are subject to our Refund Policy, which governs returns, exchanges, and refunds.

4. Prices, Billing, and Payment

Prices, discounts, and promotions may change without notice. The price charged will be the price shown at checkout at the time the order is placed, and will be reflected in your order confirmation.

Unless otherwise stated, prices do not include shipping charges or applicable taxes.

We use Shopify Payments to process payments. You agree to provide current, complete, and accurate payment and billing information. You represent that you are authorised to use the payment method provided.

Pricing Errors

If a product is listed at an incorrect price or with incorrect information due to an error, we may refuse or cancel orders placed for that product, even if the order has been confirmed and your payment processed. If your payment has already been processed, we will issue a refund.

5. Shipping and Delivery (United States Only)

We currently ship only to customers within the United States.

Delivery times are estimates and are not guaranteed. We are not responsible for shipping delays caused by carriers or events outside our control.

Once we transfer the products to the carrier, title and risk of loss pass to you, to the extent permitted by law.

6. Intellectual Property

All content and materials made available through the Services — including trademarks, logos, text, images, graphics, product photography, audio, video, and the design and arrangement of such content — are owned by KUR Labs LLC or its licensors and are protected by intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent, except as permitted by applicable law.

“Shopify” and related marks are trademarks of Shopify. All other trademarks are the property of their respective owners.

7. Optional Tools

We may provide access to third-party tools as part of the Services. Such tools are provided “as is” and “as available” without warranties. We do not control these tools and are not responsible for your use of them.

8. Third-Party Links

The Services may contain links to third-party websites or services. We are not responsible for third-party content, policies, or practices. If you access third-party sites, you do so at your own risk.

9. Relationship with Shopify

The Services are powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases made through our store are made directly with KUR Labs LLC.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and KUR Labs LLC, including any injury, damage, or loss resulting from purchased products. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with us.

10. Privacy

Our collection and use of personal information is governed by our Privacy Policy. Because the Services are hosted by Shopify, Shopify may collect and process personal information in order to provide and improve the platform services.

11. Feedback and Reviews

If you submit reviews, comments, ideas, suggestions, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including commercial use (for example, marketing and promotion).

You represent that you own or have the necessary rights to submit Feedback and that your Feedback does not violate any law or third-party rights.

We may remove Feedback at our discretion.

12. Errors, Inaccuracies, and Omissions

Occasionally, the Services may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping charges, delivery times, or availability. We reserve the right to correct these and to cancel orders if information is inaccurate.

13. Prohibited Uses

You agree not to use the Services for unlawful purposes or in a way that could harm us, Shopify, or others. You may not:

Sections that by their nature should survive termination will survive, including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and all products are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

16. Limitation of Liability

To the fullest extent permitted by law, in no event shall KUR Labs LLC (or our officers, directors, employees, contractors, service providers, affiliates, licensors), or Shopify and its affiliates, be liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, arising from or related to your use of the Services or products.

In jurisdictions that do not allow exclusion or limitation of certain damages, our liability will be limited to the maximum extent permitted by law.

17. Indemnification

You agree to indemnify, defend, and hold harmless KUR Labs LLC, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any claim, liability, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to:

your breach of these Terms;
your violation of any law; or
your infringement of any third-party right.

18. Severability

If any provision of these Terms is held to be unlawful or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remainder will remain in full force and effect.

19. Waiver; Entire Agreement

Our failure to enforce any right or provision is not a waiver.

These Terms and any policies referenced constitute the entire agreement between you and us regarding the Services and supersede prior agreements or understandings.

20. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms without restriction.

21. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to conflict of laws rules.

You agree that any dispute arising out of or related to these Terms or the Services will be brought in the state or federal courts located in New York, and you consent to personal jurisdiction and venue in those courts.

Headings are for convenience only and do not affect interpretation.

23. Changes to These Terms

We may update these Terms from time to time. The most current version will be posted on the Site with an updated “Last updated” date. Your continued use of the Services after changes become effective constitutes acceptance.
